Trademark Registration in Mumbai

To register a trademark in Mumbai, you search the Trade Marks Registry database for conflicting marks, choose the correct class or classes for your goods or services, and file Form TM-A online with the Registry, after which the ™ symbol can be used. The application is examined, published in the Trade Marks Journal for opposition, and registered if no objection succeeds, at which point the ® symbol may be used. Finaccle handles the search, filing and replies throughout.

What a trademark protects and who should file

A registered trademark gives you the exclusive right to use a brand name, logo, tagline or other distinctive sign for the goods or services it is registered for, and the right to take legal action against infringement.

Businesses should consider filing as soon as they settle on a brand, ideally before launching a website, packaging or marketplace listing. Delaying registration risks someone else filing a similar mark first.

It matters especially for consumer brands, restaurants, apps and content creators, where the name itself is a major asset. Marketplace brand registry programmes also generally ask for a trademark application or registration.

Filing steps and documents

The process begins with a search of the Registry database for identical or similar marks in the relevant classes. Goods and services are grouped into 45 classes under the Nice Classification, and choosing the right ones and describing your goods or services accurately is critical.

Form TM-A is then filed with the applicant's details, the mark, class, description and the date from which it has been used, or a statement that it is proposed to be used.

Documents include the applicant's identity and address proof, the logo in JPEG format if applicable, a signed authorisation for the attorney or agent, and, where a prior-use date is claimed, an affidavit with supporting evidence such as invoices.

Brand protection for Mumbai businesses

Mumbai is home to the Head Office of the Trade Marks Registry, and applicants with their principal place of business in Maharashtra fall under its jurisdiction for hearings and proceedings.

The city's consumer, food and media sectors make trademark conflicts common. Restaurant and cafe names, fashion and beauty labels, and production house names are often similar to existing marks, so a thorough prior search before investing in branding is worth the effort.

For film, OTT and music businesses, trademark protection for titles, channel names and production banners works alongside copyright protection for the content itself, and the two serve different purposes.

Why file your trademark with Finaccle

Many objections come from a weak search, wrong class selection or a vague description of goods and services. Our team runs the search, explains the risks we find in plain terms and recommends classes based on what you actually sell or plan to sell.

Filing is done online, and you can share documents digitally with our Mumbai team at Andheri West.

If the Registry issues an examination report, we draft the reply with legal reasoning and supporting evidence. If the mark is opposed after publication, we guide you through the counter-statement stage. We do not promise registration, since that depends on the Registry and third parties.

Trademark Registration in Mumbai: FAQs

Can I use the ™ or ® symbol after filing in Mumbai?

You can use ™ as soon as the application is filed, to indicate that you claim the mark as yours. The ® symbol can be used only after the trademark is actually registered. Using ® before registration is not permitted and can attract penalties under the Trade Marks Act, so wait for the registration certificate first.

How many classes should I file my trademark in?

File in every class covering goods or services you currently offer or genuinely plan to offer. A clothing brand would usually file in class 25, and a cafe in class 43. Each class needs a separate fee, so adding classes without real plans increases costs. A prior search helps identify which classes carry conflict risk.

What happens if I receive an examination report?

The examination report lists objections, such as similarity to an existing mark or lack of distinctiveness. A written reply must be filed within the time allowed, generally one month from receipt, explaining why the objections should be waived, supported by evidence of use where available. The examiner may accept the reply or schedule a hearing.

How long does a registered trademark remain valid?

A registered trademark is valid for ten years from the date of application and can be renewed indefinitely for further periods of ten years each. A renewal request should be filed before expiry. If it is not renewed, the mark may be removed from the register, although restoration is possible within a limited window after expiry.
